1. Introduction and definitions
1.1. These Terms of Service set out the rules for using the Huracan Trading website, operated by DSZ IT GROUP SPOLKA Z OGRANICZONA ODPOWIEDZIALNOSCIA, with its registered office in Gdynia (81-006) at ul. Morska 230/III, entered in the register of entrepreneurs of the National Court Register (Krajowy Rejestr Sadowy) under KRS number 0001029462, NIP 9581732932, REGON 524954892, as well as the conditions for providing services by electronic means.
1.2. The services we provide are of a digital nature and are delivered by electronic means. They do not constitute tangible goods, which is significant for the rights and obligations of the user, including the right of withdrawal from the contract.
1.3. Definitions of terms used in these Terms:
- Service Provider - DSZ IT Group sp. z o.o., being the owner and operator of the Huracan Trading service
- Service - the online platform available at the domain huracantrading.com
- User - a natural person, legal person or organisational unit using the Service
- Services - services of a digital nature provided by electronic means, in particular:
- access to trading signals
- educational materials
- market analyses
- access to the trading platform
- Digital content - data produced and delivered in digital form, constituting the subject of the Services provided
- Trial period - time-limited, free access to selected Services
- Subscription - paid, time-limited access to the Services
- Whop platform - an external platform handling the sale and distribution of Huracan Trading products and services, available at whop.com
2. Conditions for providing services
2.1. Using the Service requires:
- having full legal capacity
- reading and accepting these Terms
- consenting to the processing of personal data to the extent necessary to provide the services
- creating a user account
2.2. Registration and use of the Service means:
- acceptance of these Terms
- acceptance of the Privacy Policy
- consent to receive commercial information by electronic means
- an obligation to provide truthful data during registration and use of the Service
2.3. The Service Provider reserves the right to:
- modify the Services provided
- introduce changes to the functionality of the Service
- update the content and scope of the Services
- temporarily or permanently limit the availability of selected features
- refuse to provide services in the event of a breach of these Terms
3. Rules for using the service
3.1. The User undertakes to:
- use the Service in accordance with its intended purpose
- refrain from actions that could disrupt the functioning of the Service
- not share their account with third parties
- keep access credentials confidential
- promptly report any security breaches
3.2. The following is prohibited:
- copying and distributing content available on the Service
- using the Services for purposes contrary to law
- attempting to circumvent technical security measures
- acting to the detriment of other users or the Service Provider
- using automated tools to access the Service
4. Payments and subscriptions
4.1. General rules:
- access to the full functionality of the Service requires the purchase of a Subscription
- the prices of the Services are stated in Polish zloty and include VAT
- information on current prices can be found on the product page
- the Service Provider reserves the right to change prices and the scope of services
4.2. Types of subscription:
- monthly
- quarterly
- semi-annual
- annual (including promotional options)
4.3. Subscription rules:
- the subscription renews automatically for the next period
- it can be cancelled at any time
- cancelling the subscription results in access to the services ending at the end of the paid period
- failure to pay on time may result in suspension of access to the services
5. The Whop platform and payments
5.1. General information:
- the sale and distribution of products and services takes place through the Whop platform (Whop Inc.)
- by making a purchase, the User accepts both these Terms and the terms of the Whop platform available at: https://whop.com/terms
- the security of transactions is the responsibility of Whop and Stripe as payment operators
- all payment data is processed directly by Whop and Stripe, not by Huracan Trading
5.2. Managing your subscription:
- is handled through the user account on the Whop platform
- cancelling the subscription requires going to https://whop.com/orders/products/
- payment status and transaction history are available in the user panel on the Whop platform
- all changes to the subscription are carried out through the Whop platform
5.3. Payments and invoices:
- payments are processed by Stripe as the payment operator of the Whop platform
- invoices are generated and delivered by the Whop platform
- the time it takes to process a payment depends on the chosen payment method and operator
- complaints regarding payments should be submitted through the Whop platform
5.4. Security and data protection:
- payment card data is stored and processed solely by Stripe
- the Whop platform and Stripe comply with PCI DSS security standards
- Huracan Trading does not have access to the user's payment card data
5.5. Technical support:
- technical problems related to payments should be reported to support@whop.com
- problems accessing purchased products should be reported through the Whop platform
- substantive questions about the products should be directed to Huracan Trading
6. Trial period and promotions
6.1. Trial period:
- is voluntary and may be offered for selected services
- is available once per user
- may have limited functionality compared to the full version
- requires providing payment card data
- after the 3-day trial period ends, there is an automatic transition to a paid plan and the corresponding fee is charged
- to avoid being charged, the trial period must be cancelled within 3 days of its start
6.2. Promotions and special offers:
- are time-limited and may be subject to additional conditions
- the terms of a promotion are set out each time in its own rules
- do not combine with other promotions unless the rules state otherwise
- promotional offers, including discounts above 30% and annual packages, are subject to special conditions regarding the possibility of withdrawing from the contract
7. User rights and obligations
7.a. In the case of a dedicated service, the fee charged to the user is non-refundable and not subject to complaint from the start of its term.
7.1. User rights:
- access to purchased services for the duration of the subscription
- receiving information about planned changes to the services
- obtaining technical assistance regarding the services provided
- protection of personal data in accordance with the Privacy Policy
7.2. User obligations:
- compliance with the provisions of these Terms
- timely payment for the subscription
- using the services in accordance with their intended purpose
- not sharing content with third parties
8. Intellectual property
8.1. Copyright:
- all materials available on the Service are protected by copyright
- the user may use the materials solely for their own use
- copying, distributing and modifying the materials is prohibited
- infringement of copyright results in legal liability
9. Liability and exclusions
9.1. The Service Provider is not liable for:
- investment decisions made on the basis of the information provided
- financial losses resulting from the use of trading signals
- interruptions in access to the services caused by technical factors
- actions of third parties affecting the delivery of the services
9.2. Limitations of liability:
- educational materials and signals are informational in nature
- trading involves the risk of capital loss
- the user makes investment decisions at their own risk
- the Service Provider does not guarantee that any profits will be achieved
10. Protection of personal data
10.1. Data processing principles:
- the controller of personal data is DSZ IT Group sp. z o.o.
- data is processed in accordance with the Privacy Policy
- the user has the right to access and modify their data
- data is protected in accordance with the applicable GDPR (RODO) provisions
11. Complaints and dispute resolution
11.1. Submitting complaints:
- complaints regarding the services should be submitted to the email address indicated on the Service
- complaints regarding payments should be submitted through the Whop platform
- a complaint should include a description of the problem and contact details
- the time to process a complaint is up to 14 business days
12. Changes to the terms
12.1. Rules for introducing changes:
- the Service Provider reserves the right to change these Terms
- users will be informed of changes with 14 days' notice
- changes take effect on the date indicated in the notice of change
- using the Service after the changes are introduced constitutes acceptance of them
13. Final provisions
13.1. General provisions:
- these Terms take effect on 2024-02-05
- in matters not regulated herein, the provisions of Polish law apply
- all disputes will be resolved by the court having jurisdiction over the registered office of the Service Provider
- the invalidity of individual provisions does not affect the validity of the entire Terms
